Definitions
BurgerFuel means Burger Fuel Limited (the promoter).
BurgerFuel Hook-Up means a free BurgerFuel Side (being fenders, motobites, kumara chips, fries or a shake) awarded to the entrant.
BurgerFuel Entry Card means the information card that will be given to you when you purchase any burger from any BurgerFuel Store which explains how to enter this Sales Promotion.
BurgerFuel Store(s) means any and all stores located in New Zealand and operated by BurgerFuel or its franchisees, and in accordance with the BurgerFuel system.
Major Prize means: a trip for 4 to Japan, worth $20,000 including:
- Return economy flights to Tokyo, Japan for the winner and 3 friends;
- Return airport transfers for the winner and 3 friends;
- 7 nights’ accommodation at a 4 star hotel (2 rooms);
- Cityrama morning Tokyo tour;
- Otaku experience: Akhibara in depth tour;
- Japanese garden and sake tasting tour;
- Harajuku fashion and shopping tour.
Store Prize means a PS4™ and month Animelab prize pack which will be given away to the winning entrants as part of this Sales Promotion in accordance with clause 5. The prize includes:
- A PS4™ Console;
- A 12 month Animelab Premium subscription.
Unique Entry Code means the unique code that is printed on the Entry Card that Entrants can use to enter this Sales Promotion.
Prize Winners refers to the winners of any prizes up for grabs in this Sales Promotion.
Promotional Period means 11:00am Monday July 4th 2016 to 11:30pm Sunday 3 September 2016.
Sales Promotion means this ‘Harajuku’ Sales Promotion.
Terms and Conditions means these terms and conditions.
TERMS AND CONDITIONS:
- Entry into this Sales Promotion is deemed as acceptance of these Terms and Conditions.
1.2 These Terms and Conditions may change from time to time. It is the responsibility of the entrant to ensure they check these Terms and Conditions for any changes which will apply from the date that they are made available.
1.3 This Sales Promotion will run from 11.00am Monday July 4 2016 to 11:30pm Sunday 4 September 2016. Entries received after this time will be ineligible for entry.
1.4 BurgerFuel, its employees and their immediate families, participating agents and their associated agencies are ineligible to enter, win or be selected as friends of the Major Prize winner.
1.5 To be eligible to win any of the prizes, the entrant must be a New Zealand resident, and be able to provide proof of residency (in a form acceptable to BurgerFuel) upon request.
1.6 BurgerFuel Hook-Ups are only able to be used in conjunction with the entrant’s next BurgerFuel purchase (which must include any large burger) following receipt of the BurgerFuel Hook-Up and from the day after receipt of the BurgerFuel Hook-Up. BurgerFuel Hook-Ups are valid for 14 days from date of receipt of the BurgerFuel Hook-Up.
1.7 BurgerFuel reserves the right to request proof of a winner’s identity, for any of the prizes, in the form of a passport or driver’s licence and proof of address in the form of a utility bill, (or such other form as BurgerFuel considers acceptable). In the event that the winner(s) cannot provide BurgerFuel with proof of identity reasonably acceptable to BurgerFuel, BurgerFuel may withdraw the prize and select another prize winner for any of the prizes.
1.7 Each Unique Entry Code may only be claimed once and will grant the entrant one entry into the Sales Promotion. Entrants may enter the Sales Promotion as many times as they wish.
1.8 Only complete and correct entries are eligible for entry. BurgerFuel reserves the right to refuse any entry that BurgerFuel, in its sole discretion, considers incomplete or incorrect.
1.9 BurgerFuel reserves the right to substitute any prize in whole or in part with a substitute prize of equal or greater value.
1.10 The entrant’s cellular carrier’s standard SMS and/or internet charges apply (20c on Spark NZ, Vodafone NZ and Skinny Mobile and 9c on 2degrees). BurgerFuel is leasing the shortcode 3030 for the Promotional Period. All messages sent or received outside of the Promotional Period are in no way related to this service. BurgerFuel and its agencies, take no responsibility for any messaging costs incurred through interacting with the Sales Promotion from mobile phone networks or internet connections, or by incorrectly texting to another service, during and outside the Promotional Period, including but not limited to the excessive use of text messaging or use of any other mobile/internet service. There is no additional cost associated with receiving SMS messages from any third-party service providers in connection with this Sales Promotion.
1.11 BurgerFuel reserves the right to refuse to award any of the prizes including BurgerFuel Hook-ups to any entrant who BurgerFuel decides, in its sole discretion, has violated the Terms and Conditions of the Sales Promotion, gained unfair advantage in participating in the Sales Promotion, won any of the prizes, or BurgerFuel Hook-ups using fraudulent means (i.e. anyone who acts like a dick and ruins it for others).
1.12 BurgerFuel’s decision in relation to any of the prizes is final and no correspondence shall be entered into.
1.13 Any prizes unclaimed within 24 hours of BurgerFuel having made reasonable efforts to contact the winner using the contact details provided will be deemed forfeited and may be redistributed at the sole discretion of BurgerFuel.
1.14 BurgerFuel reserves the right, at its sole discretion, to vary, suspend, extend, or terminate the Sales Promotion at any time, and for any reason including (without limitation) if the Sales Promotion is not capable of running as planned including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of BurgerFuel that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Sales Promotion.
1.15 Prizes are non-refundable and cannot be transferred to any person or converted into cash. Prize travel, being travel associated with the Major Prize trip to Japan, may not be used in conjunction with any other competition or offer. No prizes may be auctioned, raffled or sold by any means, in part or in full. For the avoidance of doubt, should any friend of the Major Prize winner be determined by BurgerFuel as having been selected by means of an auction, raffle, draw, sale or other sub competition or Sales Promotion, BurgerFuel reserves the right to disqualify that friend and/or the prize winner.
1.16 BurgerFuel assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries. BurgerFuel assumes no responsibility for any injury or damage to entrants or any other person's computer related to or resulting from participation in or down-loading any materials in this Sales Promotion.
1.17 Neither BurgerFuel nor any other person or party associated with this Sales Promotion shall be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss) or personal injury suffered or sustained in connection with either participation in this Sales Promotion or with any prizes offered including (without limitation) any activities undertaken in connection with any prizes offered.
2.0 FURTHER CONDITIONS ASSOCIATED WITH WINNING THE ‘MAJOR PRIZE’
2.1 To be eligible to win the Major Prize, the winner and 3 friends of the winner must be either 18 or over, or if under 18, be accompanied by a parent or legal guardian on the trip or have their parent or legal guardian’s written consent to the award of the prize.
2.2 At 10:00am on Monday 5th September 2016, BurgerFuel will randomly draw a winner from all entrants who entered the Sales Promotion during the Promotional Period. The prize will be drawn at the offices of BurgerFuel at 66 Surrey Crescent, Grey Lynn, Auckland, New Zealand.
2.3 BurgerFuel shall endeavour to contact the winner by the phone or email provided upon entry. In the event that the winner cannot be contacted by BurgerFuel by 10:00am Tuesday, 6th September 2016, BurgerFuel reserves the right to award this prize to the entrant whose name is drawn second. It is the entrant’s responsibility to ensure they are available to be contacted.
2.4 The Major Prize winner must notify BurgerFuel of the following details within 48 hours of being contacted by BurgerFuel:
- The winner and the winner’s chosen friends’ names (as shown on their passports);
- phone numbers;
- addresses;
- dates winner wishes to travel between (which can be any time before Thursday 15th December 2016);
- any special assistance requirements;
- any other information reasonably required by BurgerFuel for the purposes of arranging the prize.
2.5 Once the winner has confirmed their chosen travel dates with BurgerFuel, the prize must be taken on those travel dates. If the winner and friends are unable for any reason to travel on the dates provided, the prize in whole may be forfeited.
2.6 BurgerFuel reserves the right, in its sole discretion, to alter the travel dates and/or flight times.
2.7 The winner and 3 friends must have valid documentation for travel including but not limited to passports which must meet the requirements of immigration and other government authorities at the destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities (including any costs associated with delay, will be the sole responsibility of the winner and the winner’s 3 friends.
2.8 The winner and the winner’s friends will be solely responsible for all other expenses not specifically included in the Major Prize description, including, but without limitation, meals and drinks, taxes, spending money, personal expenses, health insurance and any other incidentals.
2.9 By accepting the prize, the winner and winner’s friends, accept responsibility for all risks associated with travel, activities and participating in any related events.
2.10 The winner and winner’s friends agree to hold harmless and release BurgerFuel and their officers and employees for any responsibility or liability for any risk, loss or damage that may occur during or as a result of choosing to accept and participate in the Major Prize award.
2.11 The Winner and the winner’s 3 friends may be required to execute a release & waiver before commencing the trip, releasing BurgerFuel and its owners, employees, trip personnel, representatives, agents, directors, officers, successors and/or assigns from any and all claims for liability including but not limited to such liability arising from any acts or omissions resulting in injury or illness to body or property of trip participants while trip participants are participating in the trip including while in transit to and from Japan.
3. FURTHER CONDITIONS ASSOCIATED WITH WINNING A ‘STORE PRIZE’
3.1 At 10:00am on Monday 4th September 2016, BurgerFuel will randomly draw the winners from all entrants who entered the Sales Promotion. The prizes will be drawn at the offices of BurgerFuel at 66 Surrey Crescent, Grey Lynn, Auckland.
3.2 BurgerFuel shall endeavour to contact the winners by the phone or email provided upon entry. In the event that any winner cannot be contacted by BurgerFuel by 10:00am Tuesday, 6th September, BurgerFuel reserves the right to award this prize to a different entrant. It is the entrant’s responsibility to ensure they are available to be contacted on the date of the draw.
3.3 The prize winner must notify BurgerFuel of the following details within 48 hours of being contacted by BurgerFuel:
- name, address, contact phone number and any other information reasonably required by BurgerFuel for the purposes of arranging the prize.
3.4 The winners will be responsible for picking up the Store Prize from the BurgerFuel Store the prize was won at.
4.0 Personal Information and Privacy:
4.1 BurgerFuel respects privacy rights under the Privacy Act 1993 and will comply with the privacy principles in respect of the collection of personal information from all entrants.

5.0 Governing Law
The Terms and Conditions of this Sales Promotion will be governed by and construed in accordance with the laws of New Zealand and each entrant hereby submits to the exclusive jurisdiction of the Courts of New Zealand.
