BURGERFUEL HOUSE OF HORRORS SALES PROMOTION
In-store & Online Competition Terms and Conditions

Any information relating to this Sales Promotion on how to enter this Sales Promotion forms part of the conditions of entry. These Terms and Conditions set forth the legally binding terms for your participation in this Sales Promotion. By registering to participate in this Sales Promotion you agree to be bound by these Terms and Conditions. Please read them carefully and if you do not agree to any of the terms set out below, do not register to participate. 

1.          Definitions

“BurgerFuel” means Burger Fuel Limited.

“House of Horrors” means the web app game within which entrants who purchase any large burger during the promotional period can play to “slay” the burger monsters and win BurgerFuel goods.

“Burger Monsters” means the series of randomised character profiles on the menu which entrants can scroll through and select to slay.

"Slay" means when the entrant has fought the burger monster and won or lost.

Score” means to win one of the randomised BurgerFuel Hook Ups.

“BurgerFuel House of Horrors Hook Up” and “Hook Up” means one of the free randomised BurgerFuel  products awarded to Entrant on successfully ‘slaying’ chosen burger monster (i.e ‘Spud Fries’ (with Aioli), ‘Kūmara Fries’ (with Aioli), or ‘Motobites’ (with Entrant’s choice of dip), or a Thickshake (flavour of Entrant’s choice), or ‘Southern Fried Choppers’ (with Sriracha and Aioli) or ‘Smash Browns’ (with Aioli)) awarded to Entrants upon entry into this Sales Promotion; only able to be used in conjunction with the Entrant’s next BurgerFuel purchase, (which must include any large burger), available to redeem from the day AFTER purchase and valid until 11.59pm November 10th for redemption. The Hook Up will be served to the entrant via email upon Entrant entering their email address on the ‘You Have Scored’ page. All Hook Up Terms & Conditions will be outlined respective to the goods the entrant has won and received via email.

“House of Horrors Entry Card” means the entry card that will be given to every customer when they purchase any large burger from any BurgerFuel Store which explains how to enter this Sales Promotion.

“BurgerFuel Store” and “BurgerFuel Stores” means any and all stores located in New Zealand and operated by BurgerFuel or its franchisees, and in accordance with the BurgerFuel system.

“Entrant” means a person who participates in this Sales Promotion.

 “Entry Code” means the unique code that is printed on the House of Horrors Entry Card that Entrants can use to enter this Sales Promotion. One Info card is distributed per large burger purchase and customer can only enter once per entry code.

“Promotional Period” means 10:00am Tuesday 1st October 2024 to 11:30pm Thursday 31st October 2024.

“Sales Promotion” means this ‘House of Horrors’ Sales Promotion.

“Terms and Conditions” means these terms and conditions.

2.            HOW TO ENTER AND PLAY:

2.1         The following steps must be followed to enter the sales promotion and play House of Horrors for the chance to score free BurgerFuel Hook Ups:

Step 1: The Entrant must purchase any large burger from any BurgerFuel store in New Zealand throughout the Sales Promotion Period October 1st - 31st 2024 only, to receive a House of Horrors Entry Card which displays a QR code, the web-app game URL and their unique, single use Entry Code which is needed to play.

Step 2: Entrant must scan QR code (or web app game landing page) found on the House of Horrors Entry Card, which takes entrant to the House of Horrors landing page. Entrant then inputs unique Entry Code into entry field to play House of Horrors;

Step 3: Entrant can swipe through burger monsters to select the burger monster they wish to fight. Entrants can scroll through four monsters and selection can be made by selecting the ‘tick’ icon.

Step 4: Entrant can scroll through the House of Horrors weapon profiles to select their weapon of choice to slay their burger monster. Selection can be made by selecting the ‘tick’ icon.

Step 5: Once Entrant has selected their chosen burger monster and weapon, they can now play.

Step 6: If Entrant successfully slays their burger monster, they will be served a ‘win’ screen whereby they are required to enter their email address in the given field and press ‘SUBMIT’ to score their Hook Up. This prize will be sent via by email.

Step 7: If Entrant is not successful in slaying their burger monster, they have a total of THREE opportunities to play to slay and score Hook Ups.  If after three attempts the Entrant is not successful in their monster and weapon selections, they will be redirected to a receive a Boo-by prize which entitles them to a single Hook Up. They will be required to enter their email address in the given field and press ‘SUBMIT’ to score their Hook Up by email

3.          SALES PROMOTION CONDITIONS:

3.1        Entry into this Sales Promotion is deemed as acceptance of these Terms and Conditions and confirmation that the Entrant has the necessary authority and capacity to participate.

3.2        Entry into this Sales Promotion is deemed as acceptance that the entrant participating in this promotion is consenting to a response email from BurgerFuel, when entering their email address and selecting ‘SUBMIT’ to receive their Hook Up by email.  

3.3        Entrant will have the opportunity to sign up to the BurgerFuel VIB Club loyalty programme after playing the BurgerFuel House of Horrors and by registering will be agreeing to the BurgerFuel VIB Club Terms & Conditions, Privacy Policy and to receiving promotional updates and general BurgerFuel news and offers, with the option to opt out at any time by clicking the unsubscribe link at the bottom of any VIB Club emails, or by emailing us at [email protected].

3.4        These Terms and Conditions may change from time to time. It is the responsibility of the Entrant to ensure they check these Terms and Conditions for any changes which will apply from the date that they are made available. 

3.5        This Sales Promotion will run from 10:00am Tuesday 1st October 2024 to 11:30pm Thursday 31st October. Entry Codes will not be active after this time.  

3.6        Each Entry Code may only be used once.  Each Entry Code submitted by an Entrant in accordance with the Terms and Conditions of this Sales Promotion shall grant the Entrant one (1) entry only to play the BurgerFuel House of Horrors game. Entrants may enter as many Entry Codes as they receive.

3.7        BurgerFuel reserves the right to exclude any person from participating in the Sales Promotion on reasonable grounds (as determined in the sole discretion of BurgerFuel).

3.8        BurgerFuel reserves the right to refuse to award the Hook ups, to any Entrant who BurgerFuel decides, in its sole discretion, has violated the Terms and Conditions of the Sales Promotion, gained unfair advantage in participating in the Sales Promotion or won any of the Hook Ups using fraudulent means.

3.9        BurgerFuel reserves the right, at its sole discretion, to vary, suspend or terminate the Sales Promotion at any time, and for any reason including (without limitation) if the Sales Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of BurgerFuel that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Sales Promotion. BurgerFuel reserves the right, at its sole discretion, to cancel, terminate, modify, extend or suspend the Sales Promotion and/or Hook-Ups.

3.10      Hook Ups scored must be redeemed in accordance with respective Hook Up Terms and Conditions, outlined in You Have Scored Emails and are non-refundable and cannot be converted into cash. No Hook Ups may be auctioned, raffled or sold by any means, in part or in full.

3.11      BurgerFuel assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries. BurgerFuel assumes no responsibility for any injury or damage to Entrants or any other person's computer related to or resulting from participation in or downloading any materials in this Sales Promotion.

3.12      Neither BurgerFuel nor any other person or party associated with this Sales Promotion shall be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss) or personal injury suffered or sustained in connection with either participation in this Sales Promotion or with any prizes offered including (without limitation) any activities undertaken in connection with any prizes offered.

3.13      BurgerFuel’s decision in relation to any of the prizes is final and no correspondence shall be entered into.

4.          PERSONAL INFORMATION AND PRIVACY

4.1        BurgerFuel respects privacy rights under the Privacy Act 2020 and will comply with the privacy principles in respect of the collection of Personal Information from any and all Entrants.

4.2        BurgerFuel will use the Entrant’s Personal Information to manage, monitor and develop the Sales Promotion.

4.3        Personal Information provided by Entrants at the time of entry is presumed to be true, and active (in the case of text or email), through to, and beyond the date of the Sales Promotion’s completion.

4.4        The Entrant can opt out at any time of the request to change or remove their Personal Information from BurgerFuel’s database. They can do so by contacting [email protected]. If no request is made, it is deemed acceptance that the information can be used at BurgerFuel’s discretion and by any other company associated with this Sales Promotion.

4.5        BurgerFuel may store an Entrant’s Personal Information on computer systems operated by third parties and will take reasonable precautions against unauthorised access and disclosure by those third parties. BurgerFuel will not share an Entrant’s Personal Information with third parties except: 

-            to the extent necessary for those third parties to provide services to BurgerFuel in connection with the Sales Promotion; and

-            as otherwise expressly permitted under these Terms and Conditions.

4.6        By entering into the Sales Promotion, the Entrant authorises BurgerFuel to disclose their Personal Information to any third party, assisting in the conduct of the Sales Promotion including suppliers, or for publicity purposes surrounding the Sales Promotion. Where any personal information is provided to a third party, the use and maintenance of an Entrant’s Personal Information by that third party is outside BurgerFuel’s control and BurgerFuel accepts no responsibility or liability for such third-party use.

4.7        Except as described in these Terms and Conditions, BurgerFuel will not disclose or use an Entrant’s Personal Information without said Entrant’s permission, unless required or permitted by law.

4.8        From time to time, BurgerFuel may send the Entrant, and the Entrant hereby agrees to receive, emails and other material relating to BurgerFuel and our related companies or products. The Entrant may opt out of receiving those emails, other materials at any time by clicking the unsubscribe link at the bottom of any marketing emails or by emailing us at [email protected] to request their email address be removed from the database following the opt-out instructions provided in the relevant communication.

4.9        By entering your email and pressing ‘Submit,’ you agree to receive marketing communications and accept our Terms and Terms and Conditions and Privacy Policy.

5.0        Governing Law 

The Terms and Conditions of the BurgerFuel House of Horrors Sales Promotion will be governed by and construed in accordance with the laws of New Zealand and each eligible Entrant hereby submits to the exclusive jurisdiction of the Courts of New Zealand.
