BURGERFUEL FUSH & CHUPS SALES PROMOTION
In-store & Online Competition Terms and Conditions Any information relating to this Sales Promotion on how to enter this Sales Promotion forms part of the conditions of entry. These Terms and Conditions set forth the legally binding terms for your participation in this Sales Promotion. By registering to participate in this Sales Promotion you agree to be bound by these Terms and Conditions. Please read them carefully and if you do not agree to any of the terms set out below, do not register to participate.
1. Definitions
“BurgerFuel” means Burger Fuel Limited.
“Fush & Chups Info Card” means the information card that will be given to every customer when they purchase any large burger or Fush & Chups Meal from any BurgerFuel Store which explains how to enter this Sales Promotion.
“BurgerFuel Store” and “BurgerFuel Stores” means any and all stores located in New Zealand and operated by Burger Fuel Group Limited or its franchisees, and in accordance with the BurgerFuel system.
“BurgerFuel Fush & Chups Ultimate SIX60 Roadie Prize” means the main prize that will be given away to the winning Entrant (must be 18 or over) as part of this Sales Promotion, in accordance with clause 4 and all its sub-clauses.
The prize includes:
• VIP Tickets for Prize Winner and three Guests to attend SIX60 SATURDAYS at McLean Park in Napier on Saturday 5th November, 2022 (updated postponed event date from Saturday 2nd April, 2022). VIP includes dedicated VIP check in and onsite staff, commemorative VIP tour laminate and lanyard, personal invitation to an exclusive pre-show Q&A with SIX60 from 4pm – 5pm, welcome beverage, VIP lounge access with dedicated bar, food outlet and toilets, seat in the stands outside lounge for concert and dedicated merch shopping opportunity.
• An exclusive meet and greet with SIX60 and backstage tour, for Prize Winner and three Guests at SIX60 SATURDAYS at McLean Park in Napier on Saturday 5th November, 2022 (updated postponed event date from Saturday 2nd April, 2022), hosted by Universal.
• A SIX60 Merchandise pack for Prize Winner • Flights to and from Auckland for Prize Winner and three Guests, if the Prize Winner and Guests lives outside of Auckland.
• Free hireage of the JUCY x BurgerFuel Condo Campervan as a means of transport and accommodation to and from SIX60 Saturdays at McLean Park, Napier on 5th November, 2022 (updated postponed event date from Saturday 2nd April, 2022). JUCY x BurgerFuel Condo Campervan to be picked up from the Auckland depot from the 31/10/2022 and returned to the Auckland depot by the 08/11/2022
• Twenty free BurgerFuel meal vouchers for Prize Winner and three Guests to use at any BurgerFuel on their road trip to and from Napier. Each meal voucher entitles bearer to any large burger, spud fries with aioli and a thickshake (or any 330ml classic soda). Meal voucher expires 30/11/2022
• $5,000 transferred to the Prize Winners stated bank account from Burger Fuel Limited on behalf of L&P New Zealand.
“Entrant” means a person who participates in this Sales Promotion.
“Valid Receipt” means an in-store till receipt or online order confirmation email proving the purchase of any large gourmet burger or the Fush & Chups Meal within the campaign period.
“Prize Winner” refers to the one winner of BurgerFuel Fush & Chups Ultimate SIX60 Roadie Prize in this Sales Promotion. Prize winner must be of 18 years of age and over.
“Guests” refers to the three people the Prize Winner has chosen to accompany them to SIX60 Saturdays, at McLean Park in Napier. All Guests must be of 18 years of age or over.
“Promotional Period” means 10:00am Tuesday 11th January 2022 to 11:59pm Monday 28th February 2022. “Sales Promotion” means this BurgerFuel Fush & Chups Sales Promotion.
“Terms and Conditions” means these terms and conditions.
2. HOW TO ENTER:
2.1 The following steps must be followed to enter into the prize draws. An entry is only valid for the prize being drawn at the time of entry.
Step 1: The Entrant purchases any large burger or Fush & Chups Meal, consisting of a Firestone Fish Burger, Spud Fries with Aioli and 330ml L&P, from any BurgerFuel Store over the Sales Promotion Period and receives a Fush & Chups Info Card.
Step 2:
Option A) The Entrant scans the QR code displayed on the Info Card, uploads a valid receipt as proof of purchase and enters their name and email address in the entry fields of the competition web page at www.burgerfuel.com/SIX60roadie.
Option B) The Entrant heads directly to the competition web page at burgerfuel.com/SIX60roadie, uploads a valid receipt as proof of purchase and enters their name and email address in the entry fields of the competition web page at www.burgerfuel.com/SIX60roadie
Step 3: Prize Winner will be selected at random, and will be notified by BurgerFuel via email if they win the BurgerFuel Fush & Chups Ultimate SIX60 Roadie Prize.
3. SALES PROMOTION CONDITIONS:
3.1 Entry into this Sales Promotion is deemed as acceptance of these Terms and Conditions and confirmation that the Entrant has the necessary authority and capacity to participate.
3.2 Entry into this Sales Promotion, and by checking the VIB tick box in the competition web page entry field, is deemed as acceptance that the entrant participating in this promotion is consenting to their email being added to BurgerFuel’s VIB database and receiving promotional updates and general BurgerFuel news and offers, with the option to opt out at any time by clicking the unsubscribe link at the bottom of any marketing emails, or by emailing us at [email protected].
3.3 These Terms and Conditions may change from time to time. It is the responsibility of the Entrant to ensure they check these Terms and Conditions for any changes which will apply from the date that they are made available. 3.4 This Sales Promotion will run from 10:00am Tuesday 11th January, 2022 to 11:59pm Monday 28 February, 2022. Entries received after this time will be ineligible for entry.
3.5 BurgerFuel, its employees and their immediate families, participating agents and their associated agencies are ineligible to enter, win. BurgerFuel reserves the right to verify the validity of entries and the eligibility of Entrants of any of the Prize Winners.
3.6 To be eligible to win any of the prizes, the Entrant must be a New Zealand resident, and be able to provide proof of residency (in a form acceptable to BurgerFuel) and vaccine status through NZ accredited Vaccine Passport.
3.7 Entrants may enter as many times as they purchase any large gourmet burger or Fush & Chups Meal.
3.8 Entrants may not enter the same receipt from the same transaction if more than one large burger or Fush & Chups Meal was bought. Multiple entries by one entrant must show different transaction times.
3.9 BurgerFuel reserves the right to request proof of a Prize Winner’s identity and vaccination status by way of Vaccination Passport, for the prize, in the form of a passport, or driver’s licence or photo ID and proof of address, in the form of a utility bill, (or such other form as BurgerFuel considers acceptable). In the event that the winner(s) cannot provide BurgerFuel with proof of identity or vaccination status reasonably acceptable to BurgerFuel, BurgerFuel may withdraw the prize and select another prize winner for any of the prizes.
3.10 Only complete and correct entries are eligible for entry. BurgerFuel reserves the right to refuse any entry that BurgerFuel, in its sole discretion, considers incomplete or incorrect.
3.11 BurgerFuel reserves the right to exclude any person from participating in the Sales Promotion on reasonable grounds (as determined in the sole discretion of BurgerFuel).
3.12 BurgerFuel reserves the right to refuse to award the BurgerFuel Fush & Chups Ultimate SIX60 Roadie Prize, to any Entrant who BurgerFuel decides, in its sole discretion, has violated the Terms and Conditions of the Sales Promotion, gained unfair advantage in participating in the Sales Promotion or won any of the prizes.
3.13 Any prizes unclaimed within 48 hours of BurgerFuel having made reasonable efforts to contact the winner using the contact details provided will be deemed forfeited and may be redistributed at the sole discretion of BurgerFuel.
3.14 BurgerFuel reserves the right, at its sole discretion, to vary, suspend or terminate the Sales Promotion at any time, and for any reason including (without limitation) if the Sales Promotion is not capable of running as planned, including if Auckland is at COVID-19 Alert Level 4, 3 or 2, Traffic Light System Red or Orange, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of BurgerFuel that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Sales Promotion. BurgerFuel reserves the right, at its sole discretion, to cancel, terminate, modify, extend or suspend the Sales Promotion and/or prizes.
3.15 Prizes are non-refundable and cannot be transferred to any person or converted into cash. No prizes may be auctioned, raffled or sold by any means, in part or in full. For the avoidance of doubt, should any Guest Prize Winner be determined by BurgerFuel as having been selected by means of an auction, raffle, draw, sale or other sub competition or Sales Promotion, BurgerFuel reserves the right to disqualify the Guest and/or the Prize Winner.
3.16 BurgerFuel assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries. BurgerFuel assumes no responsibility for any injury or damage to Entrants or any other person's computer related to or resulting from participation in or down-loading any materials in this Sales Promotion.
3.17 Neither BurgerFuel nor any other person or party associated with this Sales Promotion shall be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss) or personal injury suffered or sustained in connection with either participation in this Sales Promotion or with any prizes offered including (without limitation) any activities undertaken in connection with any prizes offered.
3.18 BurgerFuel’s decision in relation to any of the prizes is final and no correspondence shall be entered into.
4.0 FURTHER CONDITIONS ASSOCIATED WITH WINNING THE ‘BURGERFUEL FUSH & CHUPS ULTIMATE SIX60 ROADIE PRIZE’
4.1 At 10:00am on Tuesday 1st March, 2022, BurgerFuel will randomly draw a Prize Winner from all Entrants who entered the Sales Promotion during this prizes’ allocated run time. The prize will be drawn at the offices of BurgerFuel at 66 Surrey Crescent, Grey Lynn, Auckland, New Zealand. Prize may be drawn offsite if restrictions are in place due to Covid-19.
4.2 BurgerFuel shall endeavour to contact the Prize Winner by the email provided upon entry. In the event that the Prize Winner cannot be contacted by BurgerFuel by Friday 4th March, 2022, BurgerFuel reserves the right to award this prize to the Entrant whose name is drawn second. It is the Entrant’s responsibility to ensure they are available to be contacted on the date specified as the Prize Draw date.
4.3 The Prize Winner must notify BurgerFuel of the following details within 48 hours of being contacted by BurgerFuel: * Name (in full); * Phone number; * Address; * Any special assistance requirements and any other information reasonably required by BurgerFuel for the purposes of arranging the prize. *Prize winner and guests need to show proof of Vaccination by way of Vaccine Passport
4.4 If the Prize Winner is unable for any reason to travel on the dates required to make the BurgerFuel Fush & Chups Ultimate SIX60 Roadie prize, the prize (in full) may be forfeited, or re-drawn and redistributed at the sole discretion of BurgerFuel.
4.5 If Prize Winner is unable for any reason to travel on the dates required to make the BurgeFuel Fush & Chups Ultimate SIX60 Roadie prize, they must give reasonable notice (minimum of 3 weeks) for the prize (in full) to be re-drawn and redistributed at the sole discretion of BurgerFuel. If Prize winner cannot confirm they are able to accept the BurgeFuel Fush & Chups Ultimate SIX60 Roadie prize and travel on the dates required by Saturday 22nd October (3 weeks prior to event), the prize (in full) may be re-drawn and redistributed at the sole discretion of BurgerFuel
4.6 Winner must be 18 years or over and hold a full driver licence or Restricted New Zealand licence. Winner must provide their full name, date of birth and drivers licence before pick up, to be supplied to BurgerFuel correspondent.
4.7 Includes 7-days free vehicle insurance cover rental cover for a JUCY x BurgerFuel Condo Campervan Rental and Stress Free excess reduction cover
4.8 The travel in the JUCY x BurgerFuel Condo Campervan must be undertaken for seven consecutive days between the following dates 31/10/2022 – 08/11/2022
4.9 The JUCY x BurgerFuel Condo Campervan hire is non-transferable, cannot be exchanged for monetary value, the bearer will not be entitled to a refund for any unused portion of the hire.
4.10 The JUCY x BurgerFuel Condo Campervan hire is not valid in conjunction with any other promotions, offers or discounts
4.11 The winner must provide a credit card on pick up of the JUCY x BurgerFuel Condo Campervan for any additional expenses or charges that may occur whilst on the hire e.g. tolls, speeding fines, cleaning fees, camping fines etc.
4.12 Standard JUCY Terms and Conditions apply and by accepting prize, Prize Winner agrees to be bound by the standard JUCY Terms and Conditions.
4.13 All accommodation arranged as part of the prize is non-transferable or negotiable. Prize winner will have one night’s accommodation at a powered campsite for Saturday 5th November, 2022 at Kennedy Park Resort, Napier. If the Prize Winner and Guests wishes to stay at alternative accommodation, they shall do so at their own cost. It is the Prize winners responsibility to park the BurgerFuel JUCY Campervan at designated camping sites, any costs associated with this should be covered by the $5,000 cash.
4.14 The travel associated with the BurgerFuel Fush & Chups Ultimate SIX60 Roadie Prize will be subject to Air New Zealand’s General Domestic Terms and Conditions of Carriage as amended from time to time and applicable tariffs and regulations prevailing on the travel dates.
4.15 The Prize Winner and Guests will be solely responsible for all other expenses not specifically included in the prize description, and that are incurred by the Prize winner and Guests, including, but without limitation, meals and drinks, taxes, spending money, personal expenses and any other incidentals. The $5,000 cash from L&P is to cover petrol for the BurgerFuel JUCY Campervan, accommodation and any associated costs whilst travelling to and from Auckland and Napier .
4.16 By accepting the prize, the Prize Winner, accept responsibility for all risks associated with travel, activities and participating in any related events.
4.17 The Prize Winner and Guests agrees to hold harmless and release BurgerFuel and their officers and employees for any responsibility or liability for any risk, loss or damage that may occur during or as a result of the winner choosing to accept and participate in the BurgerFuel Fush & Chups Ultimate SIX60 Roadie Prize.
4.18 Non-compliance with rules by the Prize Winner may result in forfeiture of the BurgerFuel Fush & Chups Ultimate SIX60 Roadie Prize. BurgerFuel remains the final decision maker in all matters relating to the BurgerFuel Fush & Chups Ultimate SIX60 Roadie Prize. All potential hazards, travel delays or related expenses remain the responsibility of the Prize Winner.
4.19 Universal Music (or BurgerFuel) can’t be liable for VIP ticket deliverables, as this is at discretion of the promoter. VIP tickets will be distributed one week prior to concert date via email.
4.20 If the SIX60 SATURDAYS, McClean Park concert is unable to take place on the advertised date of Saturday 2nd April 2022 due to government regulations regarding COVID-19, the concert will be postponed in the first instance to Saturday 5th November 2022. If the show is still unable to go ahead on that date, the concert will be postponed a second time to Saturday 1 April 2023. Please ensure you are able to attend both the show date, and both delay dates.
4.21 In the very unlikely case where the event is cancelled the winners will not be receiving a value or refund of the tickets.
5.0 Personal Information and Privacy:
5.1 BurgerFuel respects privacy rights under The Privacy Act 2020Privacy Act 1993 and will comply with the privacy principles in respect of the collection of Personal Information “Personal Information” from any and all Entrants.
5.2 BurgerFuel will site the photo ID provided and proof of address and will collect and hold the following Personal Information from Entrants to this Sales Promotion:
- Entrant’s first and last name;
- Entrant’s age;
- Entrant’s email address;
- Entrant’s mobile and or home phone number;
- Entrant’s address details;
- Entrant’s most frequented BurgerFuel Store;
- Vaccination Certificate (My Vaccine Pass);
5.3 BurgerFuel will use the Entrant’s Personal Information to manage, monitor and develop the Sales Promotion and to contact the Entrant if they are a winner of any of the prizes or as otherwise agreed by the Entrant.
5.4 Personal Information provided by Entrants at the time of entry is presumed to be true, and active (in the case of text or email), through to, and beyond the date of the Sales Promotion’s completion.
5.5 The Entrant has a two-business-day period from the time of entry to request their Personal Information be changed or removed from BurgerFuel’s database. They can do so by contacting [email protected]. If no request is made during this time, it is deemed acceptance that the information can be used at BurgerFuel’s discretion and by any other company associated with this Sales Promotion.
5.6 BurgerFuel may store an Entrant’s Personal Information on computer systems operated by third parties and will take reasonable precautions against unauthorised access and disclosure by those third parties. BurgerFuel will not share an Entrant’s Personal Information with third parties except: - that BurgerFuel may publish an Entrant’s name in connection with the Competition if the Entrant is a Prize Winner; - to the extent necessary for those third parties to provide services to BurgerFuel in connection with the Sales Promotion; and - as otherwise expressly permitted under these Terms and Conditions.
5.7 By entering into the Sales Promotion, the Entrant authorises BurgerFuel to disclose their Personal Information to any third party, assisting in the conduct of the Sales Promotion including Prize suppliers, or for publicity purposes surrounding the Sales Promotion. Where any personal information is provided to a third party, the use and maintenance of an Entrant’s Personal Information by that third party is outside BurgerFuel’s control and BurgerFuel accepts no responsibility or liability for such third party use.
5.8 Except as described in these Terms and Conditions, BurgerFuel will not disclose or use an Entrant’s Personal Information without said Entrant’s permission, unless required or permitted by law.
5.9 From time to time, BurgerFuel may send the Entrant, and the Entrant hereby agrees to receive, emails and other material relating to BurgerFuel and our related companies or products. The Entrant may opt out of receiving those emails, other materials at any time by clicking the unsubscribe link at the bottom of any marketing emails or by emailing us at [email protected] to request their email address be removed from the database. following the opt-out instructions provided in the relevant communication.
5.10 By entering this competition, all Entrants hereby grant BurgerFuel the non-exclusive right to, tape, sound record and photograph all their activities in connection with the Sales Promotion and (if applicable) any Prizes. The Entrant agrees that BurgerFuel owns all intellectual property rights including (without limitation) copyright in any of the above-named sources of footage and in all material incorporating said footage. The Entrants agree no compensation will be offered for use of any of the above-named material.
5.11 For further information regarding Privacy and Personal Information, please refer to BurgerFuel's Privacy Policy. 10.0 Governing Law The Terms and Conditions of the BurgerFuel Fush & Chups Sales Promotion will be governed by and construed in accordance with the laws of New Zealand and each eligible Entrant hereby submits to the exclusive jurisdiction of the Courts of New Zealand.
