In-store & Online Competition Terms and Conditions

Any information relating to this Sales Promotion on how to enter this Sales Promotion forms part of the conditions of entry. These Terms and Conditions set forth the legally binding terms for your participation in this Sales Promotion. By registering to participate in this Sales Promotion you agree to be bound by these Terms and Conditions. Please read them carefully and if you do not agree to any of the terms set out below, do not register to participate. 

1.     Definitions

“BurgerFuel” means Burger Fuel Limited.

“BurgerFuel Birthday Hook-Ups” means a free BurgerFuel side (i.e ‘Spud Fries’ (with Aioli), or ‘Moto Bites’ (with Entrant’s choice of dip), or ‘Chicken Fenders’ (4 pack, with Entrant’s choice of dip), or Kumara Fries (with Aioli)) awarded to Entrants upon entry into this Sales Promotion; only able to be used in conjunction with the Entrant’s next BurgerFuel purchase, (which must include any large burger), available to redeem from the day AFTER purchase and valid for 14 days from receiving. On hook up can be used per person, per visit and is not available to be used in conjunction with any other offer. 

“Need 4 Speed Info Card” means the information card that will be given to every customer when they purchase any large burger from any BurgerFuel Store which explains how to enter this Sales Promotion.

“BurgerFuel Store” and “BurgerFuel Stores” means any and all stores located in New Zealand and operated by BurgerFuel or its franchisees, and in accordance with the BurgerFuel system.

“BurgerFuel Need 4 Speed Hypercar Experience Day Prize Draw” means one of 10 Performance Car experiences which will be given away to the winning Entrant (must be 18 or over) as part of this Sales Promotion, in accordance with clause 4 and all its sub-clauses. The prize includes:

• Tickets for prize winner to attend the BurgerFuel Need 4 Speed Hypercar Experience at Hampton Downs Motorsport Park on Monday 14^th February, 2022 (with a rain date of Tuesday 22^nd February, 2022). The event will be hosted by BurgerFuel and facilitated by Downforce Auto Events and Training. Winner will be provided with lunch and hospitality at the Hampton Downs Pit Suite.
• Prize winner will get up to 2 passenger laps in 1 or more luxury performance sports car, such as a McLaren P1, McLaren Speedtail or Bugatti Veyron.
• Photography of Prize winner and guest with cars on display
• Flights, accommodation and transfers for Prize winner if outside of Auckland, or not within reasonable proximity to Hampton Downs Motorpark
• Prize winner will receive a free BurgerFuel meal voucher to use at their next BurgerFuel visit at any BurgerFuel in NZ.

“Entrant” means a person who participates in this Sales Promotion. To be eligible to win the Need 4 Speed Hypercar Experience Prize, the entrant must be 18 or over. 

“Entry Code” means the unique code that is printed on the Info Card that Entrants can use to enter this Sales Promotion. One Info card is distributed per burger purchase and customer can only enter once per entry code.

“Prize Winners” refers to the one of ten winners of the BurgerFuel Need 4 Speed Hypercar Experience Day Prize Package in this Sales Promotion.  Each winner must be of 18 years of age and over to be able to participate in the passenger laps of any of the performance cars.

“Promotional Period” means 10:00am Friday 1 October, 2021 to 11:30pm Sunday 31 October, 2021.

“Sales Promotion” means this ‘BurgerFuel Need 4 Speed’ Sales Promotion.

“Terms and Conditions” means these terms and conditions.

2.     HOW TO ENTER:

2.1          The following steps must be followed to enter into the Prize Draws. An entry is only valid for the prize being drawn at the time of entry.

Step 1:  The Entrant purchases any large burger from any BurgerFuel Store in New Zealand over the Sales Promotion Period and receives a Need 4 Speed Info Card, which displays their Entry Code which is needed for entry submission;

Step 2 : The Entrant texts the Entry Code, with a space and their email address to 556* and they will  gain automatic entry to the BurgerFuel Need 4 Speed Hypercar Experience Day and to receive their instant Birthday Hook Up. Entry Codes can only be used once. One code equals one entry. *Standard text charges apply. See 3.10 for text charge details

Step 3:   Upon entering the Sales Promotion by either of the above means, the Entrant will receive a confirmation from BurgerFuel via text confirming they have been granted a BurgerFuel Birthday Hook-Up, (redeemable with their next BurgerFuel Purchase), and an automatic entry into the BurgerFuel Need 4 Speed Hypercar Experience Day Prize Draw. The entrants email address will be added to the VIB database to receive marketing emails, with the option to opt out at any time by clicking the unsubscribe link at the bottom of any marketing emails, or by emailing us at [email protected].

Step 4:  Entrants will be notified by BurgerFuel via phone or email if they win the BurgerFuel Need 4 Speed Hypercar Experience Day Prize Draw.

3.     SALES PROMOTION CONDITIONS:

3.1          Entry into this Sales Promotion is deemed as acceptance of these Terms and Conditions and confirmation that the Entrant has the necessary authority and capacity to participate.

3.2          Entry into this Sales Promotion is deemed as acceptance that the entrant participating in this promotion is consenting to a response text from the SMS provider, their email being added to BurgerFuel’s VIB database and receiving promotional updates and general BurgerFuel news and offers, with the option to opt out at any time by clicking the unsubscribe link at the bottom of any marketing emails, or by emailing us at [email protected].

3.3        These Terms and Conditions may change from time to time. It is the responsibility of the Entrant to ensure they check these Terms and Conditions for any changes which will apply from the date that they are made available.  Terms and Conditions can be found on this page at WWW.BURGERFUEL.COM/N4STERMS

3.4          This Sales Promotion will run from 10:00am Friday 1 October, 2021, to 11:30pm Sunday 31 October, 2021. Entries received after this time will be ineligible for entry.

3.5          BurgerFuel, its employees and their immediate families, participating agents and their associated agencies are ineligible to enter or win. BurgerFuel reserves the right to verify the validity of entries and the eligibility of Entrants of any of the Prize Winners.

3.6          To be eligible to win any of the prizes, the Entrant must be a New Zealand resident, and be able to provide proof of residency (in a form acceptable to BurgerFuel).

3.7          To be eligible to win the Age-Restricted Prize of the BurgerFuel Need 4 Speed Hypercar Experience at Hampton Downs, the Entrant must be a New Zealand resident, and eighteen (18) years of age or older, and be able to provide proof of age and residency (in a form acceptable to BurgerFuel). Entrant must have no known health or medical conditions that could put their health at risk by participating in this prize.

3.8          Each Entry Code may only be claimed once.  Each Entry Code submitted by an Entrant in accordance with the Terms and Conditions of this Sales Promotion shall grant the Entrant one (1) entry only into the BurgerFuel Need 4 Speed Hypercar Experience Day Prize Draw. Entrants may enter as many Entry Codes as they receive.

3.9          BurgerFuel reserves the right to request proof of a winner’s identity, for any of the prizes, in the form of a passport, driver’s licence or photo ID and proof of address, in the form of a utility bill, (or such other form as BurgerFuel considers acceptable). In the event that the winner(s) cannot provide BurgerFuel with proof of identity reasonably acceptable to BurgerFuel, BurgerFuel may withdraw the prize and select another prize winner for any of the prizes.

3.10        The Entrant’s cellular carrier’s standard per SMS charges apply (20c on Spark and Vodafone, 20c on Skinny Mobile and 9c on 2degrees) and/or internet charges apply.  BurgerFuel is leasing the shortcode 556 for the Promotional Period.  All messages sent or received outside of the Promotional Period are in no way related to this service. BurgerFuel and its agencies, take no responsibility for any messaging costs incurred through interacting with the Sales Promotion from mobile phone networks or internet connections, or by incorrectly texting to another service, during and outside the Promotional Period, including but not limited to the excessive use of text messaging or use of any other mobile/internet service. There is no additional cost associated with receiving SMS messages from any third-party service providers in connection with this Sales Promotion.

3.11        Only complete and correct entries are eligible for entry. BurgerFuel reserves the right to refuse any entry that BurgerFuel, in its sole discretion, considers incomplete or incorrect.

3.12        BurgerFuel reserves the right to exclude any person from participating in the Sales Promotion on reasonable grounds (as determined in the sole discretion of BurgerFuel).

3.13        BurgerFuel reserves the right to refuse to award the BurgerFuel Need 4 Speed Hypercar Experience Day prize, including BurgerFuel Birthday Hook-ups, to any Entrant who BurgerFuel decides, in its sole discretion, has violated the Terms and Conditions of the Sales Promotion, gained unfair advantage in participating in the Sales Promotion or won any of the prizes, or BurgerFuel Birthday Hook-ups using fraudulent means.

3.14        Any prizes unclaimed within 48 hours of BurgerFuel having made reasonable efforts to contact the winner using the contact details provided will be deemed forfeited and may be redistributed at the sole discretion of BurgerFuel.

3.15        BurgerFuel reserves the right, at its sole discretion, to vary, suspend or terminate the Sales Promotion at any time, and for any reason including (without limitation) if the Sales Promotion is not capable of running as planned, including if any region is at COVID-19 Alert Level 4, 3 or 2, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of BurgerFuel that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Sales Promotion. BurgerFuel reserves the right, at its sole discretion, to cancel, terminate, modify, extend or suspend the Sales Promotion and/or prizes.

3.16        Prizes are non-refundable and cannot be converted into cash. No prizes may be auctioned, raffled or sold by any means, in part or in full. For the avoidance of doubt, should any Prize Winner be determined by BurgerFuel as having been selected by means of an auction, raffle, draw, sale or other sub competition or Sales Promotion, BurgerFuel reserves the right to disqualify the Prize Winner.

3.17        BurgerFuel assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries. BurgerFuel assumes no responsibility for any injury or damage to Entrants or any other person's computer related to or resulting from participation in or down-loading any materials in this Sales Promotion.

3.18        Neither BurgerFuel nor any other person or party associated with this Sales Promotion shall be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential loss) or personal injury suffered or sustained in connection with either participation in this Sales Promotion or with any prizes offered including (without limitation) any activities undertaken in connection with any prizes or hook ups offered.

3.19        BurgerFuel’s decision in relation to any of the prizes is final and no correspondence shall be entered into.

4.     FURTHER CONDITIONS ASSOCIATED WITH WINNING THE ‘BURGERFUEL NEED 4 SPEED HYPERCAR          EXPERIENCE DAY PRIZE DRAW’

4.1          At 10:00am on Monday 1^st November, 2021, BurgerFuel will randomly draw a Prize Winner from all Entrants who entered the Sales Promotion during this prizes’ allocated run time. The prize will be drawn at the offices of BurgerFuel at 66 Surrey Crescent, Grey Lynn, Auckland, New Zealand. Prize may be drawn offsite if restrictions are in place due to Covid-19.

4.2          BurgerFuel shall endeavour to contact the Prize Winner by the phone or email provided upon entry. In the event that the Prize Winner cannot be contacted by BurgerFuel by 10:00am Wednesday 3^rd November, 2021 BurgerFuel reserves the right to award this prize to the Entrant whose name is drawn second. It is the Entrant’s responsibility to ensure they are available to be contacted on the date specified as the Prize Draw date.

4.3          The Prize Winner must notify BurgerFuel of the following details within 48 hours of being contacted by BurgerFuel:

* Name (in full);

* Phone number

* Address;

* Any special assistance requirements and any other information reasonably required by BurgerFuel for the purposes of arranging the prize. If the Prize Winner is unable for any reason to travel on the dates required to make the BurgerFuel Need 4 Speed Hypercar Experience Day, the prize in whole may be forfeited.

4.4          The Prize Winner will be responsible for travel to and from Hampton Downs Motorsport Park on the day of the Need 4 Speed Hypercar Experience Day, if they reside in a reasonable proximity to the event location.

4.5          All accommodation arranged as part of the prize is non-transferable or negotiable and if the Prize Winner is outside of Auckland and does not reside within a reasonable proximity to Hampton Downs and wishes to stay at alternative accommodation, they shall do so at their own cost.

4.6          Any travel associated with the BurgerFuel Need 4 Speed Hypercar Experience Day (if winner is outside of Auckland and does not reside within a reasonable proximity to Hampton Downs) will be subject to Air New Zealand’s General Domestic Terms and Conditions of Carriage as amended from time to time and applicable tariffs and regulations prevailing on the travel dates.

4.7          The Prize Winner will be solely responsible for all other expenses not specifically included in the prize description, and that are incurred by the winner, including, but without limitation, meals and drinks, taxes, spending money, personal expenses and any other incidentals.

4.8          Covid-19 Alert Levels and weather may restrict the BurgerFuel Hypercar Experience Day from going ahead. BurgerFuel reserves the right to substitute the BurgerFuel Need 4 Speed Hypercar Experience Day in whole or in part with a substitute prize.

4.9          Prize Winner is required to sign a Downforce waiver of liability prior to participating in the Hypercar Experience. Race suits and helmets shall be worn by all passengers during the track laps and Prize Winner must be able to fit the safety wear provided by Downforce.

4.10       By accepting the prize, the Prize Winner accepts responsibility for all risks associated with travel, activities and participating in any related events.

4.11        The Prize Winner agrees to hold harmless and release BurgerFuel and their officers and employees for any responsibility or liability for any risk, loss or damage that may occur during or as a result of the winner choosing to accept and participate in the BurgerFuel Need 4 Speed Hypercar Experience Day.

4.12        Non-compliance with rules by the Prize Winner may result in forfeiture of the BurgerFuel Need 4 Speed Hypercar Experience Day. BurgerFuel remains the final decision maker in all matters relating to the BurgerFuel Need 4 Speed Hypercar Experience Day. All potential hazards, travel delays or related expenses remain the responsibility of the Prize Winner.

5.     Personal Information and Privacy:

5.1          BurgerFuel respects privacy rights under the New Zealand Privacy Act and will comply with the privacy principles in respect of the collection of Personal Information “Personal Information” from any and all Entrants.

5.2          BurgerFuel will site the photo ID provided and proof of address and will collect and hold the following Personal Information from Entrants to this Sales Promotion:

-              Entrant’s first and last name;

 -             Entrant’s email address;

-              Entrant’s most frequented BurgerFuel Store.

5.3          BurgerFuel will use the Entrant’s Personal Information to manage, monitor and develop the Sales Promotion and to contact the Entrant if they are a winner of any of the prizes or as otherwise agreed by the Entrant.

5.4          Personal Information provided by Entrants at the time of entry is presumed to be true, and active (in the case of text or email), through to, and beyond the date of the Sales Promotion’s completion.

5.5          The Entrant has a two-business-day period from the time of entry to request their Personal Information be changed or removed from BurgerFuel’s database. They can do so by contacting [email protected]. If no request is made during this time, it is deemed acceptance that the information can be used at BurgerFuel’s discretion and by any other company associated with this Sales Promotion.

5.6          BurgerFuel may store an Entrant’s Personal Information on computer systems operated by third parties and will take reasonable precautions against unauthorised access and disclosure by those third parties. BurgerFuel will not share an Entrant’s Personal Information with third parties except: 

-              that BurgerFuel may publish an Entrant’s name in connection with the Competition if the Entrant is a Prize Winner;

-              to the extent necessary for those third parties to provide services to BurgerFuel in connection with the Sales Promotion; and as otherwise expressly permitted under these Terms and Conditions.

5.7          By entering into the Sales Promotion, the Entrant authorises BurgerFuel to disclose their Personal Information to any third party, assisting in the conduct of the Sales Promotion including Prize suppliers, or for publicity purposes surrounding the Sales Promotion. Where any personal information is provided to a third party, the use and maintenance of an Entrant’s Personal Information by that third party is outside BurgerFuel’s control and BurgerFuel accepts no responsibility or liability for such third party use.

5.8          Except as described in these Terms and Conditions, BurgerFuel will not disclose or use an Entrant’s Personal Information without said Entrant’s permission, unless required or permitted by law.

5.9          From time to time, BurgerFuel may send the Entrant, and the Entrant hereby agrees to receive, emails and other material relating to BurgerFuel and our related companies or products. The Entrant may opt out of receiving those emails, other materials at any time by clicking the unsubscribe link at the bottom of any marketing emails or by emailing us at [email protected] to request their email address be removed from the database.

5.10        By entering this competition, all Entrants hereby grant BurgerFuel the non-exclusive right to film, tape, sound record and photograph all their activities in connection with the Sales Promotion and any Prizes. The Entrant agrees that BurgerFuel owns all intellectual property rights including (without limitation) copyright in any of the above-named sources of footage and in all material incorporating said footage. The Entrants agree no compensation will be offered for use of any of the above-named material.

10.     Governing Law 

The Terms and Conditions of the BurgerFuel Need 4 Speed Sales Promotion will be governed by and construed in accordance with the laws of New Zealand and each eligible Entrant hereby submits to the exclusive jurisdiction of the Courts of New Zealand.
